Robbins Introduces Measure to Increase ATV and Snowmobile Riding Opportunities

Harrisburg – State Senator Bob Robbins (R-50) announced the introduction of legislation which would provide landowners an incentive to open their property for all-terrain vehicle (ATV), motorcycle, and snowmobile riding.

Under current law, a landowner -- who opens their property for recreational use and does not charge a fee -- is not liable for accidents that occur to others while engaged in their recreational pursuits. Senate Bill 1374 would amend the Recreational Use of Land and Water Act by clarifying that "recreational pursuits" includes motorized recreational vehicle riding.

The Pennsylvania Department of Conservation and Natural Resources has indicated to the motorized recreational community that there will be no substantial additions to riding areas in state parks and forests and that future trail opportunities should come from private landowners.

"ATV and snowmobile riding has become extremely popular in Pennsylvania, but there has not been a significant increase in areas in which to ride," said Sen. Robbins. "The reason more people do not open up their properties is because of the liability issue. All this bill does is put the responsibility where it belongs -- on the user."

There is an extraordinarily large number of riders from Pennsylvania and other States who are looking for riding opportunities in the Keystone State. This bill would have a tremendous impact by increasing the number of trails, relieving the overuse of current trails, attracting new riders, and creating new business opportunities, all of which would help the economy."

Companion legislation (House Bill 3028) has also been introduced in the House.
